Domain Registration Terms
Last updated: 2026-06-03
Draft — not yet reviewed by legal counsel. This document is written to be a serviceable first draft for review by counsel familiar with ICANN policies and domain reseller agreements. The registrar partner is a [PLACEHOLDER] until commercial terms are finalized.
These Domain Registration Terms apply when you register, renew, or transfer a domain name through the itsmysite.ai Service. They are in addition to, and form part of, our Terms of Service, Privacy Policy, and Refund Policy.
If you bring an existing domain that you registered elsewhere and only point it at our platform via DNS, these terms do not apply to the registration of that domain — they apply only to domain registrations processed through the Service.
1. Registrar of record
Domain names registered through the Service are processed by [Name.com, Inc. / OpenSRS / Tucows / TO CONFIRM] (the "Registrar"), an ICANN-accredited registrar that acts as the sponsoring registrar of record for your domain. We act as a reseller of the Registrar's services; we are not the registrar of record.
We may change registrar partners from time to time. If we do, we will give you reasonable advance notice and either (a) migrate your domain to the new registrar on equivalent terms, or (b) give you a reasonable opportunity to transfer the domain to a registrar of your choice.
2. ICANN policies that apply to your registration
By registering a domain through the Service, you agree to comply with all applicable ICANN consensus policies, including but not limited to:
- The Uniform Domain-Name Dispute-Resolution Policy ("UDRP"), which governs disputes over rights to a domain name;
- The Transfer Policy, governing inter-registrar transfers;
- The Expired Registration Recovery Policy, governing renewal grace periods and redemption;
- The Registration Data Policy and successor policies, governing the data collected and published in the Registration Data Directory Services (RDDS) / WHOIS.
You also agree to comply with the Registrar's own registration agreement, which we will make available at the time of registration.
3. Registration data and accuracy
You must provide accurate, complete, and current information for the registrant, administrative, technical, and billing contacts of your domain, and keep that information up to date. Knowingly providing inaccurate information, or failing to respond within 15 days to inquiries about the accuracy of your information, may result in suspension or cancellation of the domain under ICANN policy.
Some of your registration data is published in the public RDDS / WHOIS database by default. If your domain registrar offers a WHOIS privacy service (sometimes called "domain privacy" or "private registration") and we resell it, you may enable it to substitute proxy contact information for your own. WHOIS privacy is governed by the Registrar's privacy-service agreement.
For domain registrations subject to GDPR, the registrar's data-disclosure practices are governed by its policy and applicable law; some data may be redacted from public WHOIS as a result.
4. Renewal and auto-renewal
Domain registrations are time-limited. We attempt to auto-renew registered domains in advance of expiration, billed via your Paddle subscription. Auto-renewal requires that: - Your subscription is in good standing; - Your payment method is valid at the time of renewal; - The Registrar continues to offer the relevant TLD on commercially comparable terms.
If a renewal fails (payment failure, registrar policy change, registry policy change), we will notify you so you can take action. If a domain is not renewed by the expiration date and grace period, you may lose the domain permanently. Reclamation during the redemption grace period (where offered by the registry) may be possible but incurs a separate, registry-set redemption fee that is non-refundable.
You may disable auto-renewal at any time from your account settings.
5. Refunds for domain registration and renewal
Domain registration and renewal fees are passed through directly to the Registrar and from the Registrar to the relevant domain registry. Once a domain is registered or renewed, the fee is non-refundable, including: - The initial registration fee; - Any annual renewal fee; - Redemption fees during a grace period; - Premium-name fees for premium TLDs.
This is because the underlying registry charges us at the moment of registration or renewal and the fee is not recoverable from the registry, even if you cancel the registration immediately afterwards.
The only exceptions are: - Billing errors (e.g., duplicate charges, charges in a wrong amount) — always refunded; - Unauthorised charges — always refunded; - Statutory rights you have under applicable consumer law that cannot be contracted out of.
WHOIS privacy fees, if separately itemised, are non-refundable for the period purchased.
6. Transfers in (bringing a domain to us)
You can transfer a domain you already own to our Registrar partner, subject to ICANN's Transfer Policy: - The domain must be unlocked at your current registrar; - The domain must be at least 60 days past initial registration or its most recent transfer; - You will need an authorisation (EPP) code from your current registrar; - Transfer may include a one-year renewal of the registration as part of the fee, per ICANN policy; - You are responsible for the timely approval of any transfer-confirmation emails sent by either registrar.
Transfer fees are non-refundable once the transfer has been initiated, subject to the same exceptions in Section 5.
7. Transfers out (moving a domain away)
You can transfer your domain to another ICANN-accredited registrar at any time, subject to ICANN's Transfer Policy. We will provide the EPP code on request within the timelines required by ICANN. We will not unreasonably block, delay, or impose fees on an outbound transfer beyond what ICANN policy permits.
Reasons we may refuse or delay an outbound transfer are limited to those permitted by ICANN policy: payment dispute, UDRP proceeding, court order, evidence of fraud, recent inter-registrar transfer (60-day lock), etc.
We will not refuse an outbound transfer because you have cancelled your subscription to the Service.
8. Suspension and cancellation of a domain
A domain may be suspended or cancelled by the Registrar, the registry, or by us in the following cases: - Inaccurate or non-verifiable registration data; - Failure to respond to WHOIS verification within the required window; - A determination in a UDRP, URS, or court proceeding adverse to the registrant; - Use of the domain in violation of our Acceptable Use rules (Section 4 of the Terms); - Use of the domain in violation of the registry's or Registrar's policy; - Order of a competent court or regulator; - Non-payment of fees.
Where reasonably possible and not prohibited by law, we will give you notice before suspension or cancellation and a reasonable opportunity to cure.
Cancellation by us, the Registrar, or the registry does not, by itself, entitle you to a refund of registration or renewal fees (which are non-refundable per Section 5).
9. What happens if you cancel your itsmysite.ai subscription
Cancelling your itsmysite.ai subscription does not automatically cancel a domain registered through the Service. The domain remains registered to you until its expiration. You can: - Transfer the domain out to another registrar at any time (Section 7); - Let the registration lapse at expiration (in which case ICANN's Expired Registration Recovery Policy applies); - Continue paying domain renewal fees separately while no longer subscribed to the Service.
If you no longer have a paid itsmysite.ai subscription, the domain will not point at our infrastructure — but it remains your registered domain until you choose otherwise.
10. Disputes over domain names
If a third party claims rights in a domain you have registered, the dispute is between you and that third party. We will comply with valid orders, UDRP decisions, court judgments, or URS decisions, and may transfer, lock, or cancel a domain in compliance with such orders without further notice to you.
You agree to indemnify us and our Registrar partner for any third-party claim arising from the registration or use of your domain.
11. Premium names and reserved names
Certain domain names are designated by the relevant registry as "premium" and carry higher registration and renewal fees, which will be displayed at checkout. Other names are reserved by the registry or by us (for example, names that conflict with trademarks, sanctions lists, or our own brand) and cannot be registered through the Service.
12. Changes to these terms
We may update these Domain Registration Terms in line with changes in registrar terms, registry policies, ICANN policies, or applicable law. Material changes will be notified by email at least 30 days in advance, or sooner if required by an ICANN-mandated change.
